Man convicted of assault with a garden gnome

Charles Morrison says he was just drunk the morning he threw a solid garden gnome at his stepdaughter through a glass door. The glass from the door hit Kelsey Anderson above her right eye.

Apparently they got into an argument, and Kelsey locked herself in her room. Her stepfather then started destroyed the phone and cut the phone lines, and started yelling offensive slurs as her. When she still refused to come out, Charles grabbed a gnome from the garden and broke into Kelsey's room.

He insisted that he was not aiming for his stepdaughter, but the jury took only 90 minutes to convict him of five criminal charges, including a felony count of aggravated assault for throwing the dwarf-like statue through a glass door. He is facing up to 10 years in jail.

The gnome, about a foot tall, wore a hat, a blue shirt over a bulging stomach and a wide grin as it sat on a table in open court throughout the two-day trial. Morrison and the weapon were separated by about 2 feet of table, with the gnome facing the defendant.
